Terms and Conditions

DAP “SEAL YOUR PAD”™ SWEEPSTAKES RULES AND REGULATIONS

NO PURCHASE NECESSARY TO ENTER OR WIN. PURCHASE WILL NOT INCREASE YOUR CHANCE OF WINNING. VOID WHERE PROHIBITED BY LAW.

1.  Sponsor.
This DAP “Seal Your Pad”™ Sweepstakes (the “Sweepstakes”) is sponsored by DAP Products Inc. (the “Sponsor”).

2.  Entry Period.
The Sweepstakes begins on July 2, 2012 and ends on February 28, 2013 at 11:59 PM ET (the “Sweepstakes Period”).

3. How To Enter.
In order to enter, each participant must completely fill out the entry form (the “Entry Form”), available at www.dap.com during the Sweepstakes Period. By completing and submitting an Entry Form, each participant receives one (1) entry into the Sweepstakes.  Limit one (1) entry per person. Entry materials become the property of Sponsor and will not be acknowledged or returned. Any attempt by a participant to use multiple email addresses or accounts to multiply the number of entries, or any attempt to use an automated system or agent to submit entries, is prohibited and will result in disqualification from the Sweepstakes. In the event of a dispute as to participation, the authorized account holder of the email address submitting the Entry Form will be deemed to be the participant.  The authorized account holder of an email address is the natural person assigned to the email address by the applicable Internet access provider, online service provider, or other organization responsible for assigning email addresses for the domain associated with the email address.

4. Eligibility.
The Sweepstakes is open to legal residents of the fifty United States or the District of Columbia 21 years of age or older.  Individuals who are employees of Sponsor or its subsidiaries, RPM International Inc. (or its Consumer Group companies), or Sponsor’s sales representatives, or advertising/sales promotion agencies, and the immediate families (spouse; children living in the same household) of each, are not eligible. Void where prohibited by law.

5. Winner Selection and Notification.
A random drawing to select the winners will be held at Sponsor’s offices on or about March 21, 2013. All qualified entries will be placed in the drawing. The first fifty (50) entries drawn will be declared Potential Winners. A Sponsor representative will be present to conduct the drawing.  Potential Winners will be notified either by phone, email, or by mail within approximately ten (10) days of the drawing based on the information provided on the Potential Winner’s Entry Form.

6.  Requirements of Potential Winners.
Potential Winners will be required to complete an Affidavit of Eligibility and Liability/Publicity Release within fourteen (14) days of notification or his or her prize will be forfeited (except where prohibited by law). If any Potential Winner does not meet these requirements within the specified period, an alternate potential winner will be named.

7. Prize.
Each Winner will receive an Apple® Gift Card with a value of $500.  Fifty (50) prizes will be awarded. The total aggregate amount of all prizes awarded in connection with the Sweepstakes is $25,000.  The prize is non-transferable and is not redeemable for cash. Winners will be responsible for any and all income taxes associated with the prize. Apple® is a registered trademark of Apple Inc. Apple is not a participant in or sponsor of this promotion.

8.  Odds.
Odds of winning a prize depend on the number of eligible entries received.  Sponsor cannot predict the number of entries.

9. Conditions.
All federal, state, and local laws and regulations apply.  Void where prohibited. Sponsor shall not be responsible for any expenses incurred by participants in connection with participating in the Sweepstakes or claiming or using the prize awarded in the Sweepstakes. By submitting an Entry Form, each participant agrees to be bound by these Sweepstakes Rules and Regulations.  Any decisions related to the Sweepstakes, the Sweepstakes Rules and Regulations, the operation of the Sweepstakes, and the qualifications and eligibility of any participant are at the sole discretion of Sponsor and are final.  Each participant agrees to release and hold Sponsor, its prize supplier and advertising and promotion agencies involved in this Sweepstakes, and their respective employees, officers, directors, shareholders, agents, representatives, and their subsidiaries, parent companies, or other affiliated companies harmless from any and all damages, losses, claims, and liabilities arising out of his or her participation in the Sweepstakes or resulting from accepting or claiming the prize awarded hereunder.  Should Sponsor, in its sole discretion, determine that the Sweepstakes has been compromised by virus, bugs, hackers, or other causes beyond its control, Sponsor reserves the right to terminate the sweepstakes and choose the Winners in a fair and reasonable manner from among all eligible entries submitted prior to termination.  Participation in the Sweepstakes constitutes permission (except where prohibited by law) to use each Winner’s name, likeness, biographical information, photographs, and any statements or remarks made about winning or participating in the Sweepstakes for advertising and promotional purposes (in any medium) without additional compensation, notice, or approval.   Sponsor is not responsible for (i) lost, late, damaged, misdirected, or illegible Entry Forms; (ii) technical malfunctions, interruptions, deletions, or defects of any kind to any telephone network, computer system, computer equipment, mobile device, server, service provider or software; (iii) any theft, tampering, alteration, or destruction associated with the Sweepstakes, including the Entry Forms; (iv) unauthorized access to any network, computer system, computer equipment, mobile device, server or software, or (v) unsuccessful attempts to notify a Winner. Any attempt to damage or undermine the fair and legitimate operation of the Sweepstakes shall result in disqualification and may be prosecuted to the fullest extent of the law.

10. Winner List.
To obtain the name of the Winners send a self-addressed, stamped envelope no later than May 21, 2013, to: DAP Products Inc., 2400 Boston Street, Suite 200, Baltimore Maryland 21224, Attn: Seal Your Pad™ Sweepstakes.

11.  Privacy.
With the exception of the Winner’s name and city/state of residence, personal information collected by Sponsor solely in connection with the Sweepstakes will not be shared with third parties without Winner’s prior consent.  Sponsor may, however, share such information with its subsidiaries, parent companies or other affiliated companies.

12.  Governing Law.
All disputes concerning the construction, interpretation, validity, effect, and enforceability of these Official Rules will be governed by the laws of the State of Maryland without regard to conflicts of laws provisions.  By participating in the Sweepstakes, you agree that exclusive jurisdiction over any legal action arising out of or in connection with the Sweepstakes will be in state or federal courts located in or nearest to Baltimore City, Maryland, and by entering consent to such jurisdiction and venue.
